Commission Project

After receiving a commission request I'll get back to you asap, so that we can discuss what you want exactly and by when (if you have a preferred deadline), to put it broadly.

Payment

If I accept your request I'll send you the final price (revision fees and the likes aren't included in it, so please be aware you might have to pay additionally before you can receive the finished work), which you can choose to pay full upfront or 50% before the sketch, and another 50% after the sketch is complete.

Copyright

The art depicting your chosen subject is mine and you cannot legally claim it as your own work. I also retain the rights to showcase every commission work I've made in my portfolio and social medias to promote myself and my work.

You retain all the rights over the subject of the commission, such as the character(s), story, world, any designs, etc.

Your Responsibilities

Please provide clear guidelines, references, act respectfully, don't alter the finished art without my permission and communicate your ideas clearly so that there's no chance for misunderstandings.

If you're commissiong NSFW, it is your responsibility to know whether or not you're legally allowed to (if you're the legal adult age in your country, but at the very least 18).

Commission work

Digital delivery in a format supported by Krita.org, but the standard is PNG and JPG. Technical details are decided by you (with my help if needed), and cannot be changed after the sketching phase is finished.

The delivered commission work is for strictly personal use by the commissioner. (I don't currently offer a commercial license).

Termination & Refunds

In case of the breach of this  TOS either of us can terminate the commission. I can also terminate an in-progress commission anytime for any reason (such as something coming up in my personal life that makes it difficult to complete the commission).

Refunds will be issued based on the stage of completion at the time of termination. The maximum refund amount is determined by specific conditions and cannot exceed 90% of the total commission price.

When commissioning me you can

  • Share any sort of visual references about your character/ subject of the commission, eg. artwork, sketches, refsheet, dress-up games, etc.

  • If you have for example images on Pinterest as a sort-of reference (whether it'd be background, clothes, monsters or something completely random), I more than appreciate any visual guides, so please don't be afraid to send them to me.

  • Moodboards are welcome. (Plus if you're the sort of person who makes/ saves playlists or songs, maybe videos, I'm not against taking a look).

  • Ask about anything, including what I'm comfortable and not comfortable/ confident in drawing, eg. specific kinks, heavy gore, nudity, mecha, morbidity, etc. I don't judge people for what they like so long as it doesn't hurt others! :)

Or if you're confused by anything I say, feel free to call me out on it. English isn't my native language, so what I say might come across as gibberish.

  • Reach out to me on any social medias I've provided, even if you just simply wanna chat or inquire about commissions or just my art in general.

Changes

These Terms of Service, estimated timelines and base commission prices are subject to change anytime as seen fit by me.

1. INTRODUCTION

1.1. Agreement to Terms

These are Terms of Service (ToS) for working with Gallant Basilisk, a freelancer artist in Europe. By commissioning Gallant Basilisk you agree to these Terms.

1.2. Entire Agreement

These rules, along with any project-specific agreements, are all you need to understand the most important aspects of commissioning me.

 

2. SCOPE OF WORK

2.1. Project Scope

You (the client/ commissioner) and I (the artist) will work together to figure out what the project involves, all the details about what's needed, when it's due, and how much it costs. Any further changes must be agreed upon.

 

3. COMPENSATION

3.1. Payment

The price of the commission you'll need to pay will be negotiated and done through Artistree.

- Please note prices are subject to change any time, for any reason.

3.2. Payment Schedule

Payment will be done through the agreed method (discussed during pricing). And while it is preferred and recommended you pay full upfront (for technical reasons relating to payment processors) you do have the choice to pay in parts (eg. 50/50).

3.3. Rush Fee

Shorter deadlines can incur a 'Rush Fee' that will be add to the final price (the shorter the deadline, the larger the fee).

3.4. Currency

The standard currency I set is USD, but (as of now) there are 19 currencies (USD included) available for you to choose from.

- Preferred currency should be communicated to me beforehand, otherwise you'll have to pay in USD.

 

4. INTELLECTUAL PROPERTY & USAGE

4.1. Showcase Rights

I have the right to share the commission work in portfolios, on social media or in promotional materials. (You can decide if you'd like to remain an anonymous commissioner or if you'd like to be named).

4.2. Artistic Work Ownership

I retain the copyright over my art (not only the finished piece) under any circumstances.

You retain the copyright over your commission topic (eg. character, character design, story, worldbuilding, etc).

4.3. Usage Beyond Scope

Using the art for more than agreed on will require permission from me and will incur extra fees.

- May invoke legal action if deemed necessary.

4.4. NFTs & Crypto

You can't use the art for NFTs, AI databases or crypto stuff without my permission (which I won't give, so don't even bother).

4.5. Credit & Tagging

If you share my art on any platforms, you are required to give proper credit to me. (And while I'm an introvert who likes hiding, please don't tuck my name into an incospicous corner where nobody looks).

 

5. REVISIONS & EDITS

5.1. Feedback and Communication

Be respectful when giving feedback and when we're conversing.

5.2. Revisions

Revisions are allowed and while some are technically free of charge, after a certain amount of revisions/ multiple large revisions you'll be charged a small extra for any revisions going forward.

 

6. TERMINATION

6.1. Termination

If either I or you break a rule in the ToS, the person who didn't is allowed to cancel the commission if they wish.

6.2. Artist's Termination

I retain the right to cancel an on-going commission for any reason.

6.3. Payment upon Termination

If you cancel after I began working on your commission, but haven't finished it, you must pay for the work already completed, if you didn't pay full upfront. I retain all the rights to the unifinished commission work and I decide whether or not you receive the art completed up to that point. (Based on your reasoning behind cancelling).

6.4. Refunds

If you didn't break ToS/ we had an agreement to cancel the commission, then I'll refund you your payment, minus the price of the already done work.

6.5. Breach by Client

If you break my ToS you won't receive any refunds and I'll take all the rights over the commissioned piece (therefore I'll have the rights to turn your commission topic into a YCH, Adoptable or an available art piece for others).

6.6. Refund amount

The maximum refund the client will receive, if they are eligible for a refund, is 90% of the total price of their commission or if the client paid in deposit(s) (eg. 50% of the price) they'll be refunded that amount, minus 10% of the (at the time of termination) final price.

- The remaining 10% is deducted for discussions regarding the commission, exchanging ideas and details, etc.

7. LIABILITY

7.1. Damages

I'm not responsible for problems arising from how you use my art.

7.2. Age Requirement

Only adults (18+) can order certain types of art. Any NSFW commission is considered 18+, not just erotic works or works containing fully nude characters. (Eg. heavy gore).

I do not take any sort of responsibility/ accountability for a client below 18 commissioning me as I have no way to legally confirm the client's age, that is the duty of their legal guardians.

7.3. Right to Reject

I can refuse a commission request for any reason.

 

8. CHANGES TO TERMS

8.1. Modification of Terms

The rules in the Terms of Service can and will change as I adjust/ update it. You'll be notified of any big changes (if I deem necessary). Commissioning me afterwards means you accept these changes.

8.2. Exemption for Agreed Terms

The rules of any updated version of the ToS do not apply to past and on-going commissions. (A commission is considered on-going after the client has paid, not after the commission request was made).

9. DEADLINES & TIMELINES

9.1. Project Deadlines

Deadlines/ TAT (Turn-Around Time) will be agreed on, or established by the client, taking into account any reasons for delay (the artist's health, work, school, any unexpected occurence, etc).

9.2. Estimated delivery time

The delivery time mentioned to every commission type is an estimate and not concrete. Therefore if you have a specific date you want your commission to be finished before, please do inform me.

Failure to do so isn't my responsibility.

10. CLIENT RESPONSIBILITIES

10.1. Project Guidelines

It's your responsibility to give clear instrunctions/ ideas and reference materials (eg. artwork, photos, text description, mood boards, etc).

10.2. Professional Conduct

Be polite and don't slow down the project.

10.3. Watermarked & Non-Watermarked Versions

You get two versions of the art, one with a watermark (for sharing publicly) and one without (for personal use, strictly), unless otherwise requested.

10.4. Artwork Alteration

You can't change/ alter my art without asking for my permission.

10.5. Client Violations

If you break any rules without properly reading and understanding the ToS, they still apply.

10.6. Ghosting

If you fail to respond within a week (168 hours) after I reached out to you I will conclude the commission cancelled without any refunds. It is not possible to "pause" a commission without notice, then demand for me to finish it.

11. DELIVERY

11.1. Digital Delivery

All commissions are digital and can be requested in any format supported by Krita.org. (Please specify before I begin working on the commission).

11.2. Technical Details

All technical details (canvas size, DPI, etc) are finalised by you. Most of these technical details cannot be changed once the final sketch has been accepted and I've began working on the lineart.


12. COMMERCIAL RIGHTS

12.1. Personal Use (Standard License)

Your commission cannot be used commercially, you need to use the watermarked version for sharing, but you may use the non-watermarked version for any personal use (eg. personal printing). Properly crediting me is mandatory.

12.2. Commercial License

Your commission can be used commercially for an additional charge on top of your base commission price. Watermarked art sharing still applies. Properly crediting me is mandatory.

- Purchasing a commercial license is not currently something I allow.

12.3. Pricing for Commercial License

1. INTRODUCTION

1.1. Agreement to Terms

These Terms of Service (ToS) govern the relationship between Gallant Basilisk (the "Artist"), a freelancer artist located in Europe, and the client(s) engaging in artistic services (the "Client"). By engaging in artistic services with Gallant Basilisk, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.

1.2. Entire Agreement

These ToS, combined with any project-specific agreements, constitute the complete understanding between Gallant Basilisk and the client, supplanting any prior agreements.

 

2. SCOPE OF WORK

2.1. Project Scope

The client and Gallant Basilisk shall collaborate to define the scope of work, encompassing project details, deliverables, deadlines, and compensation. All changes/ alterations to the project scope should be consented to by both parties.

 

3. COMPENSATION

3.1. Payment

The Client shall pay Gallant Basilisk the agreed-upon compensation for the artistic services provided.

3.2. Payment Schedule

Payment terms, including the method of payment and any upfront deposits, will be mutually agreed upon between the Artist and the Client.

3.3. Rush Fee

Rush fees apply to short deadlines set by the Client.

3.4. Currency

While the standard payment currency is USD due to technical constraints, clients are encouraged to notify the artist beforehand to adjust the accepted currency for the transaction, choosing from 19 currently available currencies.

 

4. INTELLECTUAL PROPERTY & USAGE

4.1. Showcase Rights

Gallant Basilisk reserves the right to showcase commissioned artwork in portfolios, social media, or promotional materials, unless otherwise specified and agreed on.

4.2. Artistic Work Ownership

The artist retains ownership and copyright of all artistic work produced, unless stated otherwise in a separate agreement. Clients retain rights to their commission topic, not the commissioned artwork itself.

4.3. Usage Beyond Scope

Any use beyond the agreed-upon scope requires permission from the Artist and depending on use can incur additional fees/licenses.

4.4. NFTs and Crypto

Artwork and commissions may not be used as NFTs, in any crypto-based platforms, or for any AI databases without the Artist's explicit consent.

4.5. Credit and Tagging

Proper credit and tagging are mandatory when sharing commissioned work.

 

5. REVISIONS & EDITS

5.1. Feedback and Communication

Feedback and communication between the Artist and Client should be constructive and respectful.

5.2. Revisions

The Client is entitled to a specified number of minor and major revisions of the artistic work as part of the agreed-upon commission price, as informed by the Artist. Additional revisions may be subject to additional fees.

 

6. TERMINATION

6.1. Termination

Either party may terminate the agreement if the other breaches these ToS or the project agreement.

6.2. Artist's Termination

The artist retains the right to terminate a commission without specifying reasons, at any time.

6.3. Payment upon Termination

Upon termination, clients must pay for completed work (unless they paid the full price before the commission began). The artist retains all the rights to the unfinished commission piece and has full control over whether the client can receive work completed up to that point.

6.4. Refunds

If termination occurs without a client breaching Terms of Service or if both parties mutually agree, the artist will refund according to the work's completion stage. Refunds will be issued based on the stage of the commission at the time of termination, with a percentage retained for the work already completed.

6.5. Breach by Client

If the Client breaches the agreement/ToS, they are not eligible for any refund, and the Artist retains all rights to the commissioned piece.

6.6. Refund Amount

In the event that a client is eligible for a refund, the maximum refund amount they shall receive will be determined as follows:

  1. If the client has paid the full total price for their commission, the maximum refund will be 90% of the total price.

  2. If the client has made a deposit payment (e.g., 50% of the total price), they will be refunded the deposit amount, minus 10% of the final price as of the time of termination.

The 10% deduction from the refund is attributed to the costs associated with discussions, idea exchanges, and commission details.

 

7. LIABILITY

7.1. Damages

The artist is not liable for any damages, losses, or claims arising from the use of the artistic work beyond the scope of this Agreement.

7.2. Age Requirement

The artist only accepts 18+ commissions from individuals above the age of 18. Client responsibility is crucial, as age verification is impractical. The artist does not take responsibility for a client below 18 ordering 18+ commission work, the minor's guardians are.

7.3. Right to Reject

The artist reserves the right to reject commissions for any reason.

 

8. CHANGES TO TERMS

8.1. Modification of Terms

The Artist reserves the right to update or modify these Terms of Service at any time. Regular client(s) will be notified of any major/ significant changes, and continued use of the Artist's services constitutes acceptance of the modified terms.

8.2. Exemption for Agreed Terms

Changes made after agreement acceptance do not apply retroactively.

 

9. DEADLINES & TIMELINES

9.1. Project Deadlines

Project deadlines will be established and communicated to Clients, with allowances for unforeseen delays when possible.

9.2. Estimated delivery time

The timeframes specified for each commission type are intended as estimates and are not considered rigid deadlines. If you have a particular date by which you require your commission to be completed, kindly communicate this to me in advance.

Failure to provide such information beforehand absolves me of any responsibility in meeting specific, time-sensitive delivery requests.

 

10. CLIENT RESPONSIBILITIES

10.1. Project Guidelines

The Client is responsible for providing clear project guidelines, references, and any necessary materials.

10.2. Professional Conduct

Clients are expected to act respectfully and responsibly, refraining from harassment, discrimination, or hindrance of the commission process.

10.3. Watermarked and Non-Watermarked Versions

The Client will be provided two versions (base) of a commissioned piece: one with Gallant Basilisk's watermark for (strictly non-commercial) promotional purposes, and one without, for personal use.

10.4. Artwork Alteration

The delivered commission cannot be altered without the Artist's agreement or prior agreement between the Artist and the commissioning Client.

10.5. Client Violations

If the Client violates these Terms without proper review, all terms still apply.

 

11. DELIVERY

11.1. Digital Delivery

All artwork is transferred digitally in a format supported by Krita.org.

11.2. Technical Details

Technical details, such as size and DPI, are determined by the client and cannot be changed after the sketching phase concludes.

 

12. COMMERCIAL RIGHTS & LICENSES

12.1. Standard License

Clients receive an exclusive license for strictly personal use of commissioned work, proper artist credit required.

12.2. Commercial License

Clients receive an exclusive license for commercial use, subject to a higher fee and requiring proper artist credit.

- Purchase of a commercial license is not currently available.

12.3. Pricing for Commercial License
